Using E-Cigs indoors not illegal in Lincoln

Boston, New York, Chicago and now Los Angeles - several big cities are asserting their authority when it comes to puffing on E-cigarettes indoors. But what about Lincoln?

We asked the Lincoln Lancaster County Health Department if it's on the agenda, or if they've thought about bringing the idea to the city council, but we got no comment. They simply told us, they recommend businesses and restaurants create their own regulations.

Those at GNS Vapor in south Lincoln agree.

"It's an individual right and an individual decision," manager Daniel Babcock said. "I know what I'm putting into my body and I know it's not hurting others."

We called several bars in the downtown Lincoln area, all of which said they allow E-cigarette use inside their establishments.

The Nebraska Department of Health and Human Services says the following on its website:

"The Law only prohibits smoking indoors. Any cigarette-like device or tobacco product that is not 'lit' does not meet the definition of smoking."

Babcock says smoking E-cigarettes, or vaping, is becoming more and more popular in the capital city.

"As it becomes more rampant, more people know other people that are using electronic cigarettes as tobacco harm reduction devices."

Currently there is a bill in the legislature that aims to prohibit minors from buying E-cigarettes as it is technically legal, but Babcock says his and most other businesses around Lincoln already prohibit minors under the age of 18 from even coming inside stores.
